The automotive sector generates dozens of communications with legal obligations in every transaction: repair estimates requiring certified consent, warranties that must be documented, purchase contracts whose conditions must be verifiable if a dispute arises.
In practice, many of those communications still happen by standard email, phone call or WhatsApp message. None of those channels generates valid evidence before a court or a consumer inspection body.
Certified email for the automotive sector closes that gap: it turns everyday communications between workshop and customer, dealer and buyer, or fleet manager and driver into certifiable evidence that withstands any dispute.
The legal framework that requires every communication to be certifiable
Royal Decree 1457/1986: the core regulation for workshops
Royal Decree 1457/1986, which governs the activities of vehicle repair workshops, establishes two obligations whose violation is a constant source of litigation:
Article 14 — certified consent for the estimate. The workshop may only begin a repair once the customer has given their consent via a signed estimate, or has expressly and verifiably waived the right to receive one. The regulation explicitly uses the word “fehaciente” (certifiable). A standard email does not meet that requirement.
Article 16 — repair warranty. All repairs are guaranteed for at least three months or 2,000 kilometres. When a customer makes a warranty claim within that period, the business needs to certify the exact date the vehicle was collected, the exact scope of the work carried out and what was communicated at that time.
If unexpected additional faults emerge during the repair, the workshop must communicate them to the customer before acting and obtain their express consent. Without proof of that communication, the workshop is unprotected against any subsequent claim.
RDL 1/2007 and warranties in vehicle sales
Royal Legislative Decree 1/2007 (Spanish Consumer Protection Act) establishes a statutory warranty of three years for new vehicles purchased from a professional. For second-hand vehicles, the statutory minimum is one year, although this can be reduced to that floor by written agreement.
During the first six months after delivery, any fault that appears is presumed to have existed at the time of sale. The burden of proof falls on the professional seller. The delivery date of the vehicle — and everything communicated at that moment — is therefore critical information that the dealership needs to be able to prove.
Law 1/2025 on MASC: mandatory pre-litigation claim
Since 3 April 2025, Law 1/2025 on Alternative Dispute Resolution Methods requires an attempt at mediation or conciliation before going to court in many civil and commercial disputes. For that pre-litigation attempt to be properly documented, prior communications between the workshop or dealership and the customer must be on record with certified dates and content.
That is exactly what a certified communication under eIDAS and Law 6/2020 generates.
Concrete uses in repair workshops
Estimate authorisation and approval of additional work
The typical workflow in a high-turnover workshop involves sending the estimate to the customer while the car is in the shop and waiting for their approval. If that approval comes in via WhatsApp or an uncertified email, the workshop has no robust evidence if the customer later denies having given it.
With Legalpin’s certified delivery platform, the workshop sends the digitised estimate to the customer’s email address with a qualified time stamp. The system records the opening, the full content and the exact date. If the customer responds with approval, that response is also stamped.
When unexpected additional faults arise — the most contentious scenario in workshops — the certified communication proves that the workshop informed the customer before acting and that the customer gave their express consent with date and time.
Vehicle deposit receipt
Article 14 of RD 1457/1986 requires the workshop to provide the user with a receipt when the vehicle is left in the workshop’s custody. That receipt, digitally signed and sent via certified channel, is recorded with a certified date in the Legalpin evidence file.
This is the solution to the most frequent scenario in consumer complaints: the customer claims the vehicle was in better condition when it was left than when it was collected. Proof of the deposit date and the condition documented at that moment is decisive.
Communication of post-repair warranties
When handing over the repaired vehicle, the workshop must communicate the terms of the repair warranty (Art. 16 RD 1457/1986). That communication, made via certified channel, proves what was guaranteed, from what date and under what conditions.
When a customer returns claiming the repair was defective, the workshop can show exactly what work was carried out, when the vehicle was handed over and what warranty was communicated. Without that proof, the presumption operates against the workshop.
Concrete uses in car dealerships
Confirming purchase conditions
Documentation of vehicle sales transactions includes the final price, financing conditions, delivery deadline, included equipment and vehicle condition. When those conditions are confirmed in writing and via certified channel before the contract is signed, there is no room for disputes about what was promised.
With a certified send of the binding offer to the buyer, the dealership proves that the conditions were communicated in advance, that the buyer received them and that the signed contract matches what was agreed.
Notification of delivery delays
When vehicle delivery is delayed — due to availability, logistics or order modifications — the certified communication to the buyer documents that the delay was notified in time and on what terms. This prevents the buyer from claiming ignorance or exercising contract cancellation for breach without the dealership having been able to certify its diligence.
Managing warranty claims and after-sales complaints
Warranty claims are one of the most frequent scenarios in automotive after-sales. The buyer reports a fault, the dealership responds with a technical position, the repair under warranty is agreed or denied.
Every step of that process — claim received, diagnosis communicated, decision notified — needs to be on record with certified date and content. With certified communications, the dealership builds a complete file that protects its position in any proceedings before a consumer ombudsman or civil court.
Contract cancellations and defects claims
When a buyer exercises their right of withdrawal or requests rescission for hidden defects, dates are critical. The deadline to exercise warranty rights runs from the date the vehicle was delivered, and the date on which the buyer communicated the defect determines whether they acted within or outside the statutory period.
Certified electronic notification via Legalpin’s buromail certifies those dates irrefutably, both for the buyer who wants to protect their claim and for the dealership that needs to prove it responded within the required timeframe.
Concrete uses in corporate fleet management
Companies managing vehicle fleets handle a continuous flow of communications with direct legal implications: assigning vehicles to drivers, notifying usage policies, communicating fines and infringements, managing accidents and resolving incidents.
When a driver causes damage or accumulates infringements, the company needs to prove what usage policy was communicated, on what date and whether the driver received it. Without that documentation, the company is exposed to employment claims and liability for unresolved infringements.
Legalpin allows certified sending to be integrated directly into fleet management software via REST API, so each relevant communication — assignment, warning, sanction — automatically generates a certified file with no additional manual steps.
Traffic fines: notification to the responsible driver
When a fine arrives addressed to the company for a fleet vehicle, the law requires the infringing driver to be identified. The communication to the driver and their response must be on record within a specified timeframe. The same applies to employment sanctions for breach of driving policies.
A certified communication to the driver with certified date and content covers that obligation and protects the company against any appeal by the driver or the enforcement authority.
Integration with sector-specific systems
Most workshop management software (TecRMI, Autofact, etc.) and dealership CRMs (Salesforce Automotive, HubSpot, custom solutions) can be integrated with Legalpin’s API to launch certified communications automatically at critical points in the process.
That integration operates at three levels:
Automatic trigger: when the workshop software generates an estimate or closes a repair order, it automatically sends the certified notification to the customer with no additional action from the service desk.
Direct portal: when the communication is more sensitive — a warranty denial, a resolved complaint, a payment default notice — the responsible person accesses the Legalpin portal, drafts or attaches the document and sends it certified.
Signature flow: for transactions requiring documented acceptance — a high-value estimate, a maintenance contract amendment, a settlement agreement — the certified send includes a request for the customer’s electronic signature. The unified record — certified delivery plus time-stamped signature — is automatically archived.
The alternative to postal registered letters in the sector
Postal registered letters have historically been the reference tool for certifiable communications in the automotive sector: notifying contract cancellation, reporting a serious defect, proving an invoice was sent. Their drawbacks are well known: cost per send, processing time, inability to send immediately and dependence on the recipient collecting the letter at the post office.
Certified SMS with verifiable delivery adds an additional layer for urgent communications that reach the customer’s mobile phone: appointment confirmation, notification that the vehicle is ready, alert about a problem detected during inspection. Each certified SMS generates the same type of evidence file as the email, with qualified time stamp and delivery proof.
Frequently asked questions
Does certified email satisfy the “verifiable consent” requirement of RD 1457/1986?
Yes. When the service complies with the eIDAS Regulation and Law 6/2020, the certified electronic communication has in Spain the same legal effects as a registered letter with acknowledgement of receipt. It proves sending, content and delivery with recognised legal value. The “verifiable consent” requirement of Article 14 of RD 1457/1986 is met.
Can I use certified email to communicate a warranty denial?
Yes. Denying a warranty claim is a critical communication that the workshop or dealership needs to be able to prove before a consumer body or court. Legalpin’s certified evidence file documents that the communication reached the customer with that content on that date.
Does the customer need to have accepted this channel in advance?
For B2B communications, case law is more flexible. For consumer communications, it is advisable to include in the service terms or the work order a clause capturing the customer’s email address as a valid channel for notifications. That information is already typically in the estimate or the customer file in the management software.
What if the customer says they did not receive the certified estimate?
Legalpin’s evidence file proves delivery to the recipient’s inbox with a qualified time stamp. If the customer claims non-receipt, the burden of proof shifts: they must prove the message did not reach their inbox, which is practically impossible when the technical record certifies delivery.
How much does it cost to implement in a workshop or dealership?
Legalpin offers pricing adapted to operational volume, from occasional sends to high-volume plans with API integration. The cost per certified communication is significantly lower than a postal registered letter, with no additional management time.
Can I try it before committing?
Yes. Legalpin offers a free trial to check how the service works before making a decision.
