Certified email for hospitality: uses and regulations

by | Jun 4, 2026

The hospitality sector accumulates a volume of documentary obligations that few other industries match: guest registration with mandatory communication to the Ministry of the Interior, stay contracts that must be retained, personal data processed under the GDPR, highly seasonal workforces and relationships with suppliers, OTAs and tour operators where every agreed condition can become a dispute.

Most of those communications still happen by standard email, phone or messaging platforms that generate no valid evidence. When a guest complaint arrives, a tourism inspection is called or an employment claim is filed, the establishment discovers it cannot prove what it communicated or when.

Certified email for hospitality solves that problem: it turns every critical communication from the establishment into evidence with a time stamp, content hash and certified parties under the eIDAS Regulation and Law 6/2020.

The regulatory framework that creates the documentation burden

Royal Decree 933/2021: guest registration and SES Hospedajes

Royal Decree 933/2021, fully in force since 2 December 2024, requires all accommodation establishments — hotels, hostels, guesthouses, tourist apartments, rural houses, VUTs, youth hostels and campsites — to record and communicate each guest’s data to the Ministry of the Interior by electronic means within 24 hours of check-in.

The required data includes the guest’s identity, contact information, mobile number, email address, number of travellers per booking and payment method details. All of it must be retained for three years in the establishment’s own electronic records.

Sanctions range from €100 to €600 for minor infractions (errors, partial omissions, late reporting) and can reach €30,000 for serious infractions such as the complete absence of documentary records or failure to submit mandatory communications.

The guest’s email address that the establishment collects to comply with RD 933/2021 is exactly the same channel that, when managed with fully certifiable electronic notifications, turns every subsequent communication with that guest into legally binding evidence.

Processing guests’ personal data under RD 933/2021 is based on Article 6.1(c) of the GDPR (legal obligation), but the establishment still has additional obligations: informing the guest about the processing, managing requests to exercise rights (access, rectification, erasure) and being able to certify that every communication related to those rights was made and reached the recipient.

A poorly managed rights-exercise request — or one whose response cannot be proven — can lead to a complaint before the AEPD with sanctions that, for failures to respond, start at the serious tier of the GDPR.

The hotel data protection compliance guide details the critical points of that compliance. Certified email covers the most sensitive one: proving that every communication with the data subject reached its destination with the correct content within the legally required timeframe.

Law 1/2025 on MASC: pre-litigation claims now mandatory

Since 3 April 2025, Law 1/2025 on Alternative Dispute Resolution Methods requires an attempt at extrajudicial resolution before going to court in most civil and commercial disputes. In hospitality, this affects guest claims about cancellations, service failures or deposit refunds.

For that attempt to be on record, the prior communication between the establishment and the client must be documented with certified date and content. Without that evidence, the establishment arrives at court unable to show it tried to resolve the dispute through the required prior channels.

Concrete uses: the guest relationship

Booking confirmation and modification

A booking confirmation — price, dates, board type, cancellation conditions — is the foundational document of the contractual relationship with the guest. If those conditions are subsequently modified by the establishment (room change, price adjustment, board change), the notification to the guest must be certifiable.

With Legalpin’s certified digital buromail for tourism, the initial confirmation and any subsequent modification are sealed with an exact date, content hash and proof of delivery to the guest’s inbox. If the guest claims they were not notified of the change or that the conditions were different, the evidence file refutes that claim unambiguously.

Communicating cancellation policies

Cancellation conditions are the source of the highest volume of claims in hospitality. The establishment applies a late-cancellation penalty, the guest claims they did not know those conditions or received them too late.

The certified notification of the cancellation policy — with a date stamp that predates the deadline — makes that communication irrefutable evidence. When the establishment sends certified communications with verifiable delivery confirmation at the same time as the booking confirmation, the evidence record is generated automatically.

Managing guest complaints

When a guest files a complaint — about the state of the facilities, an incorrect charge, an incident during their stay — the establishment must respond within the required period and document that response. Without proof that the response reached the guest, the establishment cannot demonstrate its diligence before tourism authorities, consumer offices or courts.

Each response to a complaint sent via certified notification is documented with its full content and the delivery date. This closes the gap between what the establishment says it communicated and what the guest claims not to have received.

GDPR rights requests

When a guest requests the exercise of their GDPR rights — access to their data, rectification or erasure — the establishment has one month to respond (extendable to three months in complex cases). That response must be certifiable.

Using certified email for GDPR compliance in hospitality ensures every response to a rights-exercise request reaches the data subject with a valid time stamp, proving compliance with the deadline to the AEPD in the event of a complaint.

Concrete uses: the employment relationship in hospitality

Disciplinary communications to staff

Hospitality has one of the highest staff turnover rates of any sector in Spain. That turnover, combined with seasonality, generates a high volume of disciplinary communications: warnings, sanctions, working-hours modification notices and termination letters.

The VI State-Level Labour Agreement for the Hospitality Sector (VI ALEH) sets out the procedural requirements for disciplinary sanctions in the sector, including the obligation to hold a prior hearing with the worker before certain dismissals. Proving that hearing was convened and that the worker received notification of it is critical to preventing the dismissal from being declared unfair.

Certified HR communications in hospitality cover all of this: written warnings, sanction notices, working-hours modification notifications under Article 41 of the Workers’ Statute and dismissal letters. Each one generates its own evidence file with a time stamp.

Notifying seasonal staff of schedule changes

In hospitality, schedule changes — extended hours in high season, reductions or closures in low season — are structural. Every change that substantially affects working conditions requires formal notification to the worker with the legally required advance notice.

Without proof that the notification reached the worker in time, the establishment is exposed to an unfair dismissal claim if the worker argues they were not properly informed. The certified communication certifies the date and content of every notification, leaving no room for subsequent dispute.

Digital disconnection protocol: also mandatory in hospitality

Article 88 of the LOPDGDD and Law 10/2021 on remote working require all employers to have a digital disconnection policy and to communicate it to all staff. In a sector where employees may be contacted at any hour via shift WhatsApp groups, proving that the protocol was individually delivered and received is essential to avoiding employment sanctions.

Concrete uses: suppliers and distribution partners

Contracts with tour operators and OTAs

Allotment contracts with tour operators and distribution terms with OTAs (Booking.com, Expedia, etc.) contain cancellation penalty clauses, guaranteed rates and release conditions that are a frequent source of disputes.

When the establishment communicates a change of conditions to a distributor, that notification must be certifiable for release dates or penalties to be enforceable. Electronic signature for contract formalisation combined with certified notification of modifications creates a complete record of the contractual relationship.

Supplier payment requests and service complaints

When a food supplier, laundry service or maintenance contractor fails to deliver or overcharges, the establishment needs to prove it sent the complaint within the required timeframe and with the specific content. Without that proof, the extrajudicial or legal claim has insufficient documentary basis.

A certified notification of a payment request or a defective-service complaint generates the file needed to activate the extrajudicial channel required by Law 1/2025 on MASC, or to go directly to court with adequate evidence.

The complementary channel: certified SMS for urgent communications

Hospitality operates at a pace that makes email the ideal channel for documented communications, but there are situations where the message must reach the recipient’s mobile phone immediately: check-in reminder to the guest, urgent notice of an incident in a room, emergency staff call-out.

SMS with guaranteed legal traceability from Legalpin allows that type of communication with the same probative value as certified email: time stamp, proof of the recipient’s number and content hash. In situations where email may not be checked in time, certified SMS adds a security layer without losing the documentary evidence.

Integration with hotel management systems

Common PMS platforms in hospitality — Opera, Cloudbeds, Mews, Siteminder — can be integrated with Legalpin’s REST API to launch certified communications automatically at key points in the booking cycle.

The most common integration points are:

At booking confirmation: the PMS automatically sends the certified confirmation with cancellation conditions to the guest, without any manual input from the receptionist.

At booking modification: any change of conditions automatically generates a certified notification to the guest with the updated details.

At check-out: the certified send of the final invoice to the guest certifies the charge and the moment it was communicated.

On complaints: when the system logs a complaint, the customer care team can launch the certified response directly from the Legalpin portal, without changing their work environment.

Frequently asked questions

Yes. When the service complies with the eIDAS Regulation and Law 6/2020, the certified notification proves that the cancellation conditions reached the guest with that content and on that date. That evidence is decisive when the guest claims they were unaware of them.

Can I use the email address I collect for RD 933/2021 to send certified communications?

Yes, as long as the establishment’s terms of use and privacy policy reflect email as a communication channel. That channel is already accepted by the guest as part of their contractual relationship with the accommodation.

Is certified email valid for communicating disciplinary sanctions to hospitality staff?

Yes, provided the worker has previously accepted that channel — which can be recorded in the employment contract or a signed annex. With that clause in place, certified email has full validity for sanctions, schedule changes and termination communications.

What if the guest claims they did not receive the booking confirmation with the cancellation terms?

Legalpin’s evidence file proves delivery to the recipient’s inbox with a qualified time stamp. If the guest claims non-receipt, the burden of proof shifts: they must prove the message did not reach their inbox.

How much does it cost for a hotel?

Legalpin offers pricing scaled to the establishment’s booking and communication volume, from boutique hotels with few reservations to chains with high throughput. API integration is available on higher-volume plans.

Can I try the service before committing?

Yes. There is a no-cost trial that lets you verify the full service functionality before making any decision.
