The court upheld a challenge by the Valencian Government and ruled that the State lacked the constitutional competence to impose a national register that duplicated existing regional registration systems.

The practical result: the unique registration number that property owners needed to list their flat on Airbnb, Booking or any other digital platform has no legal basis. But this is not a clean slate. The landscape for owners and managers of tourist rentals has become more complex, not simpler.

Understanding what remains legally required, what now falls to each autonomous community and how to protect every communication with guests, platforms and neighbours is more urgent today than it was before.

What the Unique Register was and why the Supreme Court annulled it

Royal Decree 1312/2024, enacted on 23 December 2024, was the Spanish Government’s response to EU Regulation 2024/1028 on data collection and exchange for short-term rental platforms. Its central mechanism: any property intended for tourist or short-term rental and advertised through a digital platform had to be registered with the Land Registry or the Registry of Moveable Assets to obtain a unique number to present to the platform.

The Supreme Court held that this design exceeded the State’s constitutional powers. Spain’s autonomous communities already have their own tourist accommodation registries (Catalonia, Andalusia, Valencia, Madrid, the Balearic Islands…) and the regulation of tourism is a competence the Constitution assigns to the regions. Creating a mandatory second national register, administered by Property Registrars, overlapped those existing systems without sufficient constitutional authority.

The ruling is partial: it preserves the Ventanilla Única Digital de Arrendamientos (Digital Single Window for Rentals), the platform data-transmission obligations and statistical data exchange, where the court does find valid state competence.

What remains in force: what the ruling does not change

The annulment of the national register does not mean property owners are free of all obligations. The following remain fully in effect:

Regional registries and local licences. Each autonomous community maintains its own holiday accommodation authorisation system. Operating without the corresponding regional licence or registration remains a sanctionable infringement. The Balearics require their regional registration number; Catalonia applies its own restrictions; Andalusia has its own Tourism Registry. None of that has changed.

Platform data obligations. Airbnb, Booking and similar platforms remain obliged to collect and transmit data on their listings under EU Regulation 2024/1028. Although the national unique registration number no longer exists as a requirement, platforms will adapt their systems to request the applicable regional or local licence number instead.

Digital Single Window. The central portal for information exchange between public administrations remains operational. Owners who had already completed their registration should verify with their autonomous community what effect this has on their current authorisation.

Community of owners rules. Spain’s Horizontal Property Law and the amendments introduced by Law 12/2023 continue to allow property owners’ associations to restrict or prohibit tourist rentals by a qualified majority vote. This process is entirely independent of the annulled national register.

The new landscape: more fragmentation, more legal exposure

If the problem before was one confusing register, there are now seventeen. Each autonomous community applies its own framework, with different criteria for what constitutes a tourist rental, what licences are required, how many days per year a property can be rented out and how many tourist beds a municipality can host.

This means a property owner renting in three different regions, or a management company operating across several provinces, must navigate three distinct regulatory frameworks — while platforms may still request registration numbers that no longer exist at state level.

The regulatory uncertainty has a concrete practical cost: conflicts with neighbours’ associations, digital platforms, guests who booked during the transition period and public authorities still processing sanction proceedings all increase. In all those scenarios, the ability to prove what was said, when and to whom is the difference between resolving a dispute with solid documentary evidence or litigating without it.

Why certified notification is now more critical than ever

Communications with the community of owners

The owners’ association is the first conflict front for tourist property owners. A meeting resolution restricting or prohibiting tourist rentals must be formally notified to the affected owners. Without certified notification, the owner can argue they had no knowledge of the resolution within the legal deadline.

Equally, if the owner wants to challenge a resolution they consider unlawful or disproportionate, they must do so in writing within the statutory period. Buromail or certified email with a qualified timestamp are the channels that guarantee the challenge has a certified date and content that cannot be disputed before a court.

Notifications to guests during regulatory changes or cancellations

The annulment of the national register creates a transition period during which some owners may be forced to cancel reservations or inform guests of changes to the property’s situation as a consequence of administrative adjustments or the temporary removal of a listing.

A cancellation or modification communicated via a platform message with no certified acknowledgement does not provide sufficient proof if the guest claims compensation. Certified email lets you send the guest a notification with the complete message content and the exact date, generating a dispatch certificate that serves as documentary evidence in any claim. For related scenarios, see the post on certified email for rental deposit refund claims.

Responding to administrative proceedings and inspections

Property owners with open proceedings initiated by regional or municipal authorities cannot respond with a standard email. Administrative deadlines run from the date the notice was received, and the response must prove its dispatch date.

Buromail or certified email generate a certificate proving the response was submitted before the deadline, without requiring a trip to a post office. For a detailed comparison of options, read the guide on ways to prove you sent an email with legal guarantees.

Communicating with digital platforms

Airbnb, Booking and other platforms are adapting their compliance systems in the wake of the ruling. Owners will receive notifications about new documentation requirements. Proving that you provided the correct regional licence documentation within the window the platform sets is exactly the type of scenario where certified email prevents a platform from claiming it never received your update in time.

Rent collection from seasonal tenants

Seasonal rental — legally distinct from tourist rental, though both were covered by the annulled decree — can also generate disputes over contract terms, condition changes or payment demands. A formal payment demand sent via buromail or certified email interrupts the statutory prescription period and provides the documentary proof needed to proceed to court if necessary.

How to document every key communication legally

Situation

Recommended channel

Why

Challenging an owners’ meeting resolution

Buromail or certified email

Certifies the date and content of the written challenge

Notifying guest of cancellation or change

Certified email

Full dispatch certificate with message content

Responding to an administrative notice

Buromail

Immediate delivery, complete traceability

Informing a platform of a licence update

Certified email

Proof the information was sent within the required period

Rent payment demand to a tenant

Buromail or certified SMS

Interrupts prescription, documents arrears

Serving notice to terminate a contract

Buromail

Equivalent legal weight to a postal burofax

For the actual signing of tourist or short-term rental contracts, electronic signature allows the agreement to be completed remotely with full legal validity, with no need for the guest or the owner to be physically present.

Common mistakes tourist property owners make in this new scenario

Waiting for regional regulation to “settle down”

The ruling does not suspend existing regional law. Regional registries remain active. Operating without a valid regional licence exposes the owner to sanctions that in some autonomous communities exceed €100,000.

Assuming the annulment removes all obligations

The Supreme Court only annulled the national register. Digital platforms will still require registration data. Regional authorities will still open proceedings. Owners’ associations will still vote on restrictions.

Using channels with no evidentiary value

A WhatsApp message to a guest or a standard Gmail to a platform is not sufficient proof if a claim follows. In a period of regulatory transition, disputes increase and the ability to certify every communication is the first line of defence.

Not retaining previous dispatch certificates

If the owner registered with the Unique Register and the situation is now changing, all documentation of that process must be preserved. Certified communication records have indefinite evidentiary value; they do not expire.

Not notifying guests with existing bookings

Guests who made reservations tied to a registration number that no longer has legal backing have the right to be informed of any change in the conditions. A certified notification to the guest before arrival prevents a last-minute compensation claim on check-in day.

Frequently asked questions

Is my Unique Register number still valid for anything?

The Supreme Court annulled the provisions that created the obligation to obtain that number to advertise on digital platforms. However, if your autonomous community has its own tourist accommodation registry and you were already registered there, your regional number remains valid. Verify your situation with the regional tourism authority.

Will Airbnb and Booking take down my listings?

Platforms are not obliged to act immediately. They will continue operating while adapting their systems to the new framework. It is expected they will request a regional licence number rather than the now-annulled state registration number. Communicate with them via certified email to document that you have provided updated regulatory information within any deadline they set.

Can the owners’ association still prohibit tourist rentals?

Yes. The ability for a community of owners to restrict or prohibit tourist rentals by a three-fifths majority vote is entirely independent of the annulled national register. It derives from the Horizontal Property Law and has not been affected by the Supreme Court ruling.

What happens to the sanction proceedings already open against me?

Proceedings opened by regional or municipal authorities continue on their course. The annulment of the national register does not extinguish obligations arising from regional registers. Respond to any administrative notice via buromail to certify the response date and content.

Are tourist rental contracts signed before the ruling still valid?

Yes. The ruling does not affect the validity of existing contracts. It affects the obligation to register with the national registry. The rights and obligations between owner and guest are governed by the contract and the applicable civil and tourism legislation.

Do I need to notify my current guests of any change?

Only if your property’s situation changes in a way that affects the agreed conditions. If the annulment does not affect your regional licence or the property’s characteristics, there is no notification obligation. If any change of conditions arises, communicate it via certified email to document the advance notice.

General information based on Supreme Court ruling 620/2026 of 19 May 2026.
